IRON ORE LEASE CANCELLED….Le 50M COST AWARDED

The High Court in Kenema has cancelled two different lease agreements made between the Paramount Chief of Tunkia Chiefdom, Kenema District PC Gowai Sama, Chiefdom Speaker, Alhaji Sheku V Kanneh Pa. Moinina DBL Kallon and one Steven Cosser of 115 Eaton Square, London for the mining of Iron Ore deposits in the Bagla Hills in the Tunkia Chiefdom Kenema District, Eastern Sierra Leone.

Judgment delivered by the presiding Judge, Justice Deen Tarawallie on  28th May,2012 in the matter between Pa Moinina DBL Kallon latter substituted by his daughter Fatmata Mamie Kallon, Alhaji Abdulai Mansaray and Bockarie Magoi all of the Tunkia Descendants Association  as Plaintiffs and PC Alhaji Jobo Gowai Sama, Steven Cosser of the Red Rock Mining Ltd SL and thirteen others as Defendants had alleged that the agreements dated 20th December2010 and 2nd February 2011 were forged documents and same be expunged.  A cost of Fifty Million Leones was awarded to the Plaintiffs.

 

On  21st November, 2011, C.F Margai and Associates of  Banta Chambers at 40 Rawdon Street Freetown filed in a writ on behalf of the Plaintiffs claiming among others things that the lease agreement dated  20th day of December 2010 is said to have been made between Alhaji Amara Jobo Sama, Alhaji Sheku V Kanneh, Chiefdom Speaker Pa Moinina DBL Kallon and others and Steven Cooser was a forged document  and be revoked and the lease agreement dated 2nd February 2011 and 16th February 2011 respectively registered in No.10/2011at page 107 in volume 105 and No.13/2011 at page110 in volume 105 of the Record Books of lease kept in the office of Registrar General in Freetown be expunged on the grounds that they were forged documents. Signatures appearing on the lease agreement of the Defendants indicating that the first and second Plaintiffs are not their signatures since they did not sign the said documents, some defendants fraudulently put out themselves to have been representing family heads and thus involved in the agreement.

Throughout the court sittings, which lasted for six months, the Plaintiffs were represented by Lawyer Robert B. Kowa while Brewah & Co registered as Solicitors for the Defendants.

The 20th December,2010 lease agreement was traded by Steven Raymond Cooser to Sable Mining Company in London for Three million Pounds Sterling thereby giving right to Sable Mining Company to take over  ownership of the Bagla Hills with an estimated iron ore deposit of about 3.1billion tons.
